Terms of Service

Effective August 5, 2026

These Terms of Service govern your use of the Present Index website and data contribution program.

By submitting information to Present Index, you agree to these Terms and the Privacy Policy.

What the program is

Present Index invites adults to submit information about their use of AI assistants for review as a potential paid data contribution. A submission is an application for review, not a guaranteed sale or payment.

  • You run the Present Index activity prompt in the AI assistant you use and paste the complete, unedited response.
  • You provide the requested profile and eligibility information.
  • You may share a personal referral link after submitting.

Eligibility

  • You must be at least 18 years old.
  • The AI account and conversations must be yours, not another person's, a shared account, or an employer-owned account.
  • You may maintain only one submission identity unless Present Index invites you to contribute again.
  • You must have the right to share everything included in your submission.

Review and payment

Submitting does not guarantee acceptance or payment. Payouts are issued only after a submission passes review and is approved for purchase.

The early-access payout is $75 for an approved contribution. The standard payout is $50. The rate shown when you submit applies if the contribution is later approved. Present Index may change rates for future submissions without reducing an already-recorded rate.

You are responsible for taxes on payments you receive. Present Index may request tax information when required by law. We will never charge you a fee to participate.

Submission requirements

  • The activity-prompt response must be pasted exactly as returned. Edited, truncated, summarized, or reformatted responses may be rejected.
  • The submission must reflect genuine use of your own AI account. Fabricated, copied, manipulated, or bulk-created submissions are prohibited.
  • Do not submit employer confidential information, information covered by a confidentiality obligation, or private information about another person that you do not have the right to share.
  • If the returned response contains information you are not comfortable sharing, do not submit it.
  • You are responsible for complying with the terms of your AI provider.

Approval and rejection

We may review authenticity, completeness, eligibility, duplication, and fraud signals. We may reject submissions that do not meet these Terms. Where practical, we may explain the general reason or invite a corrected submission.

Present Index may pause or close the program to new submissions. A pause does not change the review status of a submission already received in good faith.

License to approved data

You keep ownership of your contributed data. If a submission is approved and paid, you grant Present Index a perpetual, irrevocable, worldwide, transferable, and sublicensable license to use, reproduce, process, modify, distribute, and commercially license the approved contribution for AI development, research, evaluation, and related commercial purposes.

Before licensing contribution data to a buyer, Present Index removes direct profile identifiers and takes reasonable steps to reduce identifying details. Buyer agreements prohibit attempts to re-identify contributors.

Once approved data has been licensed or used to train a model, that use may not be reversible. Review the Privacy Policy before submitting if this concerns you.

You represent that you have the right to grant this license and that your submission complies with these Terms.

Referral program

You may earn $5 when a person uses your personal referral link and their resulting submission is approved and paid. A signup, click, or unapproved submission does not earn a referral payment.

  • Do not spam referral links or post them where solicitation is prohibited.
  • Do not misrepresent the program or promise guaranteed payment.
  • Self-referrals, duplicate accounts, and manipulated attribution are prohibited and do not qualify.

Prohibited conduct

You may not submit fabricated or manipulated data, misrepresent your identity or age, create duplicate identities, interfere with the site, scrape protected parts of the service, submit data you have no right to share, or use the program for fraud. Violations may result in rejection, account closure, forfeiture of unearned payments, or recovery of fraudulent payments where permitted by law.

Your AI provider

The activity prompt runs inside your own AI assistant account under your agreement with that provider. Present Index does not connect to your account and will never ask for your account password. AI-generated activity reports may contain errors; you are required not to alter the returned output, not to guarantee that the AI is correct.

Ending participation

You may stop participating at any time before submitting. Present Index may exclude participants who violate these Terms. Approved, paid, and licensed contributions remain subject to the license described above.

Disclaimers

The site and program are provided as is. We do not guarantee that the program will remain open, that future rates will remain unchanged, that any submission will be approved, or that the site will operate without interruption. Nothing in these Terms limits rights that cannot legally be limited.

Limitation of liability

To the maximum extent permitted by law, Present Index is not liable for indirect, incidental, special, or consequential damages arising from the site or program. Any direct liability is limited to the greater of $100 or amounts actually owed for an approved contribution. Where law does not permit a limitation, it applies only to the fullest extent permitted.

Indemnification

You are responsible for third-party claims caused by your breach of these Terms, including claims that you submitted data you did not have the right to share or license.

Disputes

The laws applicable to the dispute govern these Terms. A dispute may be brought in a court that has legal jurisdiction over the parties and the dispute. Nothing here prevents either party from using an available small-claims process or seeking urgent injunctive relief.

General

If any provision is unenforceable, the remaining provisions stay in effect. These Terms and the Privacy Policy are the entire agreement governing participation. We may update these Terms by posting a revised version. Material changes apply prospectively and do not reduce payment for a contribution already approved under an earlier version.
